Tree Services Terms and Conditions
Last updated: 1 May 2026
These Terms and Conditions apply to tree surgery, arboricultural, vegetation management and related services provided by Great Oaks Tree Services Ltd, company number 11384925, of Freshfield Farm, Lower Lane, Freckleton, Lancashire, PR4 1TS.
In these Terms, “we”, “us” and “our” means Great Oaks Tree Services Ltd. “Client”, “you” and “your” means the person, business or organisation instructing us to carry out the works.
By accepting a quotation, instructing us to proceed, issuing a purchase order, confirming acceptance by email, signing an acceptance form, or otherwise allowing works to commence, you agree to these Terms and Conditions.
1.1 Quotations are based on the information available to us at the time of pricing, including any site inspection, photographs, plans, written instructions or access information provided by the Client.
1.2 Unless stated otherwise, quotations are valid for 30 days from the date of issue.
1.3 A contract is formed when the Client accepts the quotation in writing, by email, by purchase order, by signed approval, through our booking system, or by otherwise clearly instructing us to proceed.
1.4 The quotation will identify the works to be undertaken. Any additional works, changes to scope, access restrictions, delays, or unforeseen site conditions may result in additional charges.
1.5 The Client is responsible for checking that the quotation accurately reflects the works required before acceptance.
2.1 The Client must tell us about any Tree Preservation Order, conservation area, planning condition, felling licence requirement, lease restriction, covenant, SSSI designation, protected habitat, protected species issue, or other legal restriction affecting the site or the trees.
2.2 Unless expressly agreed in writing, the Client remains responsible for obtaining any required permissions, consents, licences or approvals before works commence.
2.3 Where agreed, we may assist with checks or applications for tree works consent, but we cannot guarantee approval by the relevant authority.
2.4 We reserve the right to postpone or cancel works if the necessary permissions, consents or information have not been obtained.
2.5 The Client agrees not to instruct us to carry out unlawful works.
3.1 The Client must provide safe, clear and reasonable access to the work site, including access for vehicles, machinery, equipment and personnel where required.
3.2 The Client must tell us about any known hazards, including underground services, overhead services, septic tanks, unstable ground, hidden structures, fragile surfaces, restricted access, livestock, dogs, ponds, watercourses, asbestos, contaminated land, sharps, or other site-specific risks.
3.3 Unless marked and notified to us in advance, we are not responsible for damage to hidden, underground or concealed services or structures.
3.4 The Client must ensure that vehicles, garden furniture, ornaments, plant pots, play equipment and other movable items are removed from the work area before we arrive.
3.5 If we are unable to carry out the works safely or efficiently because of access issues, unsafe conditions, undisclosed hazards, third-party obstruction, or Client delay, we may charge for wasted time, additional labour, plant, travel or rearranged attendance.
4.1 We will carry out works in accordance with applicable health and safety requirements, industry good practice and our risk assessment procedures.
4.2 We may stop, delay or change the method of work if we consider it unsafe to proceed.
4.3 The Client, occupiers, visitors, children, pets and other third parties must stay outside exclusion zones and follow any safety instructions given by our staff.
4.4 We reserve the right to leave site or suspend works if our staff are subject to abusive, threatening, unsafe or unreasonable behaviour.
5.1 Works may be delayed, changed or cancelled where wildlife, nesting birds, bats, protected species, protected habitats, pollution risks or environmental constraints are identified.
5.2 If protected species or nesting birds are discovered during the works, we may need to stop work and agree an alternative method, timing or further ecological advice.
5.3 Additional costs arising from ecological restrictions, delays, surveys, licences or revised methods may be chargeable.
6.1 Tree works will be carried out in line with the agreed specification and, where applicable, with reference to BS3998: Tree Work Recommendations.
6.2 Unless stated otherwise, timber, branches, woodchip and other arisings will be removed from site.
6.3 Where the quotation states that arisings are to be left on site, the Client is responsible for their storage, use or disposal after completion.
6.4 Stump grinding, root removal, timber splitting, log stacking, traffic management, parking permits, waste transfer, specialist machinery, additional visits and making good of surfaces are only included where expressly stated in the quotation.
6.5 We will take reasonable care to avoid unnecessary damage, but tree works can involve heavy timber, machinery and access equipment. The Client accepts that some minor disturbance to lawns, beds, tracks, surfaces or ground conditions may be unavoidable.
7.1 Any change to the agreed works must be agreed in writing.
7.2 If additional works are requested while we are on site, we may provide a further price or agree a daywork / hourly rate before proceeding.
7.3 We may charge additional costs where unforeseen circumstances arise, including hidden defects, decay, difficult access, unsafe trees, wasps or bees, utilities, contaminated material, weather disruption, traffic management requirements, or restrictions imposed by a third party or authority.
8.1 Prices are as stated in the quotation.
8.2 VAT will be charged where applicable.
8.3 Unless otherwise agreed in writing, payment is due on completion of the works and issue of invoice.
8.4 For larger works, commercial contracts, training-related works or works requiring materials, plant, permits or third-party costs, we may require a deposit, staged payment or payment in advance.
8.5 If payment is not made by the due date, we reserve the right to charge interest and reasonable recovery costs in accordance with applicable law.
8.6 The Client must raise any query about an invoice within 7 days of receipt. The undisputed part of any invoice remains payable by the due date.
9.1 Cancellations or postponements must be made in writing.
9.2 For commercial clients, or for works not subject to consumer cancellation rights, we may charge reasonable costs for late cancellation, postponed works, wasted attendance, booked plant, materials, permits, traffic management, subcontractors or allocated labour.
9.3 If the Client cancels after materials, permits, specialist equipment, waste arrangements, ecological surveys, traffic management or other third-party costs have been committed, those costs may be chargeable.
10.1 This section applies where the Client is a consumer and the contract is made at a distance or away from our business premises, for example by email, telephone, online communication, or during a visit to the Client’s property.
10.2 Where the Consumer Contracts Regulations apply, the Client has the right to cancel the contract within 14 calendar days without giving any reason.
10.3 The cancellation period starts the day after the contract is entered into.
10.4 To cancel, the Client must notify us clearly in writing by email or post before the end of the 14-day cancellation period.
10.5 The Client may use the model cancellation form at the end of these Terms, but does not have to do so.
10.6 We will not normally begin works during the 14-day cancellation period unless the Client expressly asks us to do so.
10.7 Where the Client asks us to begin works within the 14-day cancellation period, the Client agrees that we may start work before the cancellation period has expired.
10.8 If the Client cancels after asking us to start within the 14-day cancellation period, the Client must pay a reasonable amount for the works carried out up to the point of cancellation, together with any reasonable costs already incurred.
10.9 If the works are fully completed during the 14-day cancellation period following the Client’s express request for us to start, the Client acknowledges that the right to cancel will be lost once the works have been fully performed.
10.10 These cancellation rights do not affect the Client’s statutory rights where services are not carried out with reasonable care and skill.
11.1 We may cancel, delay or postpone works due to weather, unsafe site conditions, staff illness, equipment failure, emergency works, access issues, nesting birds, protected species, lack of permissions, or other circumstances beyond our reasonable control.
11.2 Where we postpone works, we will arrange a new date as soon as reasonably practicable.
11.3 We are not liable for loss arising from delay where the delay is caused by circumstances outside our reasonable control.
12.1 The Client must notify us of any concern or complaint as soon as reasonably possible, and preferably within 7 days of completion.
12.2 We must be given a reasonable opportunity to inspect the works and, where appropriate, put matters right.
12.3 The Client must not arrange for another contractor to alter, complete or remedy the works before giving us a reasonable opportunity to inspect and respond, unless there is an immediate safety risk.
12.4 Complaints will be handled in accordance with our Customer Care Policy and Complaints Procedure.
13.1 We will carry out the works with reasonable care and skill.
13.2 Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
13.3 We are not responsible for pre-existing damage, hidden defects, decay, structural weakness, ground instability, concealed services, undisclosed hazards, or damage caused by inaccurate or incomplete information supplied by the Client.
13.4 We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, loss of amenity, or third-party claims, except where such liability cannot legally be excluded.
13.5 For business clients, our total liability will not exceed the contract price for the relevant works, except where liability cannot legally be limited.
13.6 For consumer clients, nothing in these Terms affects statutory rights.
14.1 We maintain appropriate insurance for the services we provide.
14.2 Evidence of insurance can be provided on request.
15.1 Waste and arisings will be handled in accordance with our waste carrier registration, waste exemptions and applicable waste regulations.
15.2 Where arisings are removed from site, they become our responsibility unless otherwise agreed.
15.3 Where arisings are left on site at the Client’s request, the Client accepts responsibility for them after completion.
16.1 We collect and process customer personal data as necessary to provide quotations, manage bookings, deliver works, communicate with Clients, issue invoices, keep business records, respond to complaints and comply with legal, accounting, insurance and regulatory obligations.
16.2 Personal data may include names, addresses, telephone numbers, email addresses, site details, job records, photographs, correspondence, payment details and invoicing information.
16.3 We will only use personal data where we have a lawful basis to do so, including contract administration, legitimate business interests, legal compliance, insurance purposes, accounting requirements and customer communication.
16.4 Where necessary, personal data may be shared with our employees, approved subcontractors, insurers, accountants, professional advisers, payment providers, local authorities, planning authorities, regulators or other parties where required for the proper delivery of the works or compliance with legal obligations.
16.5 We will not sell customer personal data.
16.6 Job photographs may be taken for operational, record keeping, training, quality assurance, insurance, compliance or evidential purposes. We will not intentionally publish identifying personal information without appropriate permission.
16.7 Personal data will be kept only for as long as reasonably necessary for the purposes set out above, including legal, tax, insurance, contract and record keeping requirements.
16.8 Customers have rights under UK data protection law, including the right to request access to personal data, correction of inaccurate data, deletion where applicable, restriction of processing, objection to processing, and the right to complain to the Information Commissioner’s Office.
